NZRPG Shopping Centre Gift Card Terms & Conditions

1. General

1. The purchase or use of an NZRPG Shopping Centre Gift Card (“Gift Card”) constitutes acceptance of these Terms & Conditions. Anyone using the Gift Card is also bound by these Terms & Conditions.
2. These Terms & Conditions apply to Gift Cards issued for participating NZRPG shopping centres, including Westgate Shopping Centre, Milford Shopping Centre, Fraser Cove Shopping Centre and The Plaza Shopping Centre (“Shopping Centre”).
3. Each Gift Card is specific to the Shopping Centre identified on the Gift Card and may only be used at participating retailers at that Shopping Centre.
4. Participating retailers may change from time to time. A current list is available on the relevant Shopping Centre website.
5. These Terms & Conditions are governed by New Zealand law.

2. Purchasing and Loading a Gift Card

6. Gift Cards may be purchased through the participating Gift Card agent, as advertised by the relevant Shopping Centre.
7. Gift Cards may be loaded with an amount between $20 and $1,000.
8. A Gift Card can only be loaded once. Additional funds cannot be added to an existing Gift Card. A new Gift Card must be purchased if additional value is required.
9. You are responsible for checking that the amount loaded onto the Gift Card is correct at the time of purchase.
10. The Gift Card is activated at the time of purchase and can be used once activated.

3. Gift Card Expiry

11. A Gift Card expires 36 months from the date of purchase.
12. The expiry date is displayed prominently on the Gift Card in accordance with applicable New Zealand law.
13. Any unused balance remaining after the expiry date will be forfeited and cannot be refunded, transferred to another Gift Card or otherwise redeemed.
14. The expiry date cannot be extended unless required by law.

4. Using Your Gift Card

15. A Gift Card may be used to purchase goods and services from participating retailers at the Shopping Centre identified on the Gift Card.
16. A Gift Card cannot be redeemed for cash, refunded or transferred.
17. If the purchase amount exceeds the Gift Card balance, the remaining amount may be paid using another payment method, subject to the retailer’s payment policies.
18. Any remaining balance may be used for future purchases until the Gift Card expires.
19. Participating retailers may determine whether more than one Gift Card can be used in a single transaction.
20. A Gift Card cannot be used for online purchases from participating retailers unless expressly stated otherwise by the relevant retailer.
21. A participating retailer may refuse to accept a Gift Card where it reasonably suspects that the Gift Card has been stolen, obtained fraudulently or obtained unlawfully.
22. Goods and services purchased using a Gift Card remain subject to the participating retailer’s own terms, conditions and policies.

5. Balance and Transactions

23. The Gift Card balance and expiry date can be checked through the relevant Shopping Centre website or the Gift Card provider’s online platform.
24. If you believe there has been an error in a transaction, you should first contact the retailer where the transaction occurred. You may also contact NZ Retail Property Group for assistance.

6. Lost, Stolen or Faulty Gift Cards

25. A Gift Card should be treated like cash and kept in a safe place.
26. NZ Retail Property Group is not responsible for loss arising from a lost or stolen Gift Card or unauthorised use before the Gift Card is reported to NZ Retail Property Group.
27. Lost or stolen Gift Cards will not be replaced or refunded unless otherwise required by law.
28. Gift Cards must not be copied, reproduced, altered, tampered with or defaced. A Gift Card that has been altered or tampered with may be cancelled and will not be replaced.
29. If a Gift Card is defective, contact NZ Retail Property Group on 09 831 0200. You may be required to provide reasonable evidence of purchase and identification.
30. If NZ Retail Property Group determines that a Gift Card is faulty, a replacement Gift Card may be issued with the remaining balance. The replacement Gift Card will retain the original expiry date unless otherwise required by law.

7. Returns and Refunds

31. Returns, refunds and exchanges for goods or services purchased using a Gift Card are the responsibility of the participating retailer and are subject to its policies and applicable New Zealand law, including the Consumer Guarantees Act 1993.
32. Goods purchased using a Gift Card must be returned to the retailer from which they were purchased. Any refund, exchange or store credit will be provided by that retailer in accordance with applicable law.

8. Suspension and Cancellation

33. NZ Retail Property Group may suspend or cancel a Gift Card where it reasonably believes that the Gift Card has been used fraudulently, unlawfully or in breach of these Terms & Conditions.
34. NZ Retail Property Group may suspend or cancel the Gift Card programme where reasonably necessary.
35. If the Gift Card programme is cancelled for reasons other than fraud, unlawful activity or a breach of these Terms & Conditions, NZ Retail Property Group will provide reasonable information about available options for valid Gift Cards with remaining balances.

9. Liability

36. NZ Retail Property Group is not responsible for the availability, quality, safety or fitness for purpose of goods or services purchased using a Gift Card. Any dispute concerning those goods or services should be resolved directly with the participating retailer.
37. Nothing in these Terms & Conditions limits, excludes or modifies any rights or remedies you may have under applicable New Zealand law, including the Consumer Guarantees Act 1993 and Fair Trading Act 1986.

10. Changes and Privacy

38. NZ Retail Property Group may amend these Terms & Conditions by publishing updated Terms & Conditions on the relevant Shopping Centre website or Gift Card platform. Changes will not affect rights already accrued under a Gift Card except where permitted or required by law.
39. NZ Retail Property Group and/or the Gift Card provider may collect and use personal information where necessary to administer the Gift Card programme, process transactions, provide customer support, investigate fraud or comply with legal obligations. Personal information will be handled in accordance with applicable New Zealand privacy law and the relevant privacy policy.

11. Other Terms

40. The Gift Card may not be copied or reproduced.
41. If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions will continue to apply.
42. These Terms & Conditions apply to Gift Cards issued for NZRPG Shopping Centres and should be read together with any information provided on the relevant Gift Card, packaging or Gift Card platform.
